GENERAL TERMS AND CONDITIONS FOR THE REGISTERED MEMBERS OF FEVER VIP CLUB.

1. Fever VIP Club is operated by HTMLs Radio Fever 104 FM.
2. Membership is open to Indian Residents having completed 18 years on the date of Participation and above only, having a valid Identification Proof and a mobile phone numbers. Membership is purely voluntary and participants can send in their registration entries as details above by way of SMS at 54242. No entry fee is payable for publication/membership in the Fever VIP Club, except Premium SMS Charges, as applicable as charged by the respective telecom operators.
3. Only one membership is allowed per mobile number for a period of 1 year from the date of registration. Thereafter, the membership may be renewed by Fever 104 FM at its own discretion.
4. HTML is not responsible for delayed SMSs regardless of the reason for the delay.
5. To terminate/un-register your Fever VIP Club membership, you have sms to 54242, more detailed above. Please note that if you un-register, you will lose all your points and you will not be able to get them back with immediate effect. And to be a part of Fever VIP Club, you have register afresh.
6. Employees of HT Media Ltd, sponsors of the prizes, associated agencies and their immediate family members and relatives are not eligible Membership in the Fever VIP Club.
7. The registered Members can also get themselves registered for Fever 104 Alerts. The process is mentioned herein above. Similarly a Member can un-register himself/herself for Fever 104 Alerts.
8. HT Media Ltd shall not be responsible for any loss or damage suffered by the Members/participants while participating in any Contest organized by Fever 104. And any Failure by HT Media Ltd to enforce any of these Rules in any instance(s) shall not give rise to any claim by any Member. Further HT Media Ltd shall not be responsible in any way for failure/delays of any backend technology and the resultant inability of a reader to send in his entry or register/participate in any contest.
9. Only correct entries received by HT Media Ltd for any Contest during such Contest period shall be considered eligible for the registration/contest participation and HT Media Ltd., shall not be responsible for non-receipt of any entry. HT Media Ltd., does not take any responsibility for any errors arising out of incorrect or incomplete entries. Only those participants who SMS the correct entry (as determined by HT Media Ltd) shall be eligible to participate such contest.
10. The Members /Participant must use there registered mobile number for sending contest entries for which valid ownership proof can be produced. Multiple entries from the same mobile phone number shall not be accepted. At the time of redemption/collecting of Points/Gifts/Prize, Members shall be required to satisfy HT Media Ltd that winning entry was sent by him/her registered mobile number by producing appropriate verification of their mobile number to HT Media Ltds satisfaction & photo ID. In case false/fake identification details are submitted, the concerned participant/winner shall be disqualified.
11. The Members/Participants of Fever VIP Club can participate in any promotional interaction or Fever 104 FM and /or such contests/campaigns organized by HT Media Ltd on Fever 104 FM from time to time to win points. Please also note that, the Members/Participants also agrees to adhere and accept to such other T&Cs applicable to such other Contest to be organized by HT Media Ltd on Fever 104 FM.
12. Though HT Media Ltd shall make every effort to declare the results of the contest on the due date for the Gifts/Prize draws, however it shall not be responsible for any delay in announcing winners of the respective prize draws arising out of reasons beyond its control.
13. All entries will be treated as the property of HT Media Ltd and can be used by HT Media Ltd for any promotional and / or commercial activity & the Members/Participants/Winners waive all rights of whatsoever nature in the said entries in favour of HT Media Ltd by participating in such contest.
14. HT Media Ltd in its absolute discretion may publicize, broadcast or otherwise disclose a Members/Participants/Winners name, particulars, likeness, statements or any recording Confidential. Property of HT Mobile Solutions. Unauthorized copying and distribution is prohibited of their voice in advertising or promotional activities concerning this contest, or generally. HT Media Ltd may promote or advertise that a Member/Winner has won the contest or has redeemed his/her points successfully. HT Media Ltd may also require its Members/Participants/Winners to participate in a photo, video and/or film session and acknowledge that HT Media Ltd has the absolute and exclusive right to use such publicity photos, videos and/or films in any medium and in any reasonable manner it may deem fit without any consideration or payment of similar nature to such Members/Participants/Winners.
15. For redeeming the earned points, the Members shall be required to SMS to 54242 and in return he/she will get the details of the top 5 items/products which can be redeemed against his/her total points. The same informations shall also be available at the website of Fever 104FM subsequently. The redemption shall be purely first come first serve. However, the Members further understands that, if the above mentioned "listed Items" are not available then HT Media Ltd shall workout for alternate options, which the members agrees to abide by. Other process with regards to Redemption of points is detailed above.
16. The Members/Winners shall be solely responsible for any other expenses, loss or damages related to the acceptance/use of the offer or participation in any contest. Any levies, duties, incidental charges and taxes wherever applicable, shall be borne by the Mebmers/Winners availing the Gifts/Prize. Tax deductable at source under Income Tax Act is applicable for any prize exceeding the value of Rs. 5,000/- .The winner shall submit the proof of depositing the tax due on the prize (i.e. challan of depositing the tax) at the time of claiming the prize. In case the Members/Winners doesnt have a PAN number, then HT Media Ltd shall have the discretion to disqualify the Members/Winners from the Contest. The Members/Winners of the prizes shall be required to come to the offices of Fever 104, HT Media Ltd at 17th Floor, "Hindustan Times House, 18-20, Kasturba Gandhi Marg, New Delhi 110001" or such other place as HT Media Ltd may notify, to redeem there points and/or collect their Gifts/Prizes on presentation Valid Photo Identity Proof, and Mobile Ownership proof. All costs and expenses for collection of prizes shall be borne by winners.
17. The Gifts/Prizes shall not be transferable or substituted for cash and no such request shall be entertained by HT Media Ltd. The offers cannot be clubbed with any other offer. However a registered Member of Fever VIP Club can transfer his/her membership/earned points to another mobile number. For this the process is also detailed above.
18. HT Media Ltd/Fever 104 FM shall also remind its Members, who are dormant for a maximum period of1 month from the date of its interaction, promoting them to active participation. All those registered Member of FEVER VIP club, who doesnt respond even after Reminder 1, will be pushed another reminder message after 15 days from the date of first reminder, again prompting them for active participation. And If the registered Member doesnt respond for within 6 months from the date of last action irrespective of getting reminder, his account will be unsubscribed from the club and hell be intimated accordingly.
19. In the event of any Members/s choosing not to accept a Gifts/Prize(s) and/or choosing not to redeem his/her Points within 30days of its intimation or forfeit any and/or all claims qua the Gift/Prize within 30 days its intimation or if HT Media Ltd is unable to reach/contact the Member/Winner at his/her mobile number from which entries were sent for any contest HT Media Ltd shall have the absolute discretion to deal with such Points/Gifts/Prize as it deems fit.
20. HT Media Ltd shall not be responsible for any defects/inadequacy/deficiency in the Gifts/Prizes. HT Media Ltd would not be liable to replace/exchange the prizes at any point of time.
21. In any contest, a member cannot win additional points on duplicate smses even if they are correct if he/she has already won points in that specific contest.
22. HT Media Ltd holds the right to change the products & redemption points of any existing product at any point without any prior intimation.
23. Any attempt by a Member/Participant to deliberately damage or undermine the legitimate operation of the activity is a violation of Criminal and Civil Laws and should such an Confidential. Unauthorized copying and distribution is prohibited.attempt be made, HT Media Ltd reserves the right to seek damages from any such Members to the fullest extent permitted by law.
24. All disputes shall be subject to the exclusive jurisdiction of DELHI Courts only.
25. Participation in the Fever VIP Club implies acceptance of all the terms & conditions herein.
