THESE TERMS & CONDITIONS (HEREINAFTER REFERRED TO AS THE "GENERAL RULES") ARE APPLICABLE TO ALL THE PARTICIPANTS/CONTESTANTS OF "City Quiz" (HEREINAFTER REFERRED TO AS THE "CONTEST") PROMOTED / ORGANIZED BY M/S HT MEDIA LTD (HEREINAFTER REFERRED TO AS HTML). THE RULES CAN BE AMENDED OR VARIED FROM TIME TO TIME BY HTML.

1. The contest activity starts from 21st November 2011 to 2nd December 2011 from Monday to Friday, for HTML'S radio division FEVER 104 FM listeners of Delhi, Mumbai, Kolkata and Bangalore.
2. To play the contest, listeners will have to register themselves by sending SMS FEVER <space> their name" to 54242 from their mobile.
3. HTML shall then randomly select people from the database received. Once during every contesting hour, RJ calls out to a listener selected through the randomizer and asks him a question. After asking the question RJ gives the listener the option to either answer the question himself or use a lifeline. The listener will get 5 seconds to decide whether he would like to answer the question himself or take the help of a lifeline.
4. Correct answer, participant wins Rs. 1000/-. If the listener chooses to use a lifeline then in case of a correct answer, he wins only half of the amount at stake. Listener/lifeline gets a maximum of 30 seconds to answer a question. Listeners can only register once.
5. Winners will be announced on-air and may also get a call from HTML confirming their win, if HTML think fit. The winner may collect the prize from respective fever offices, address available le on our website.
6. HTML shall not be responsible for alteration or unauthorized access to entries, or entries lost whether or not arising during operation or transmission as a result of server functions, virus, bugs or other causes beyond its control.
7. HTML shall not be liable for system/server failures. Neither can HTML be held responsible for the failure to fulfill the obligations of any of the third parties involved in the contest.
8. HTML reserves the right without prior notice to access, read preserves and/or disclose the personal information of the user if the same is required in connection with this contest
9. Decision of HTML with respect to selection of winners shall be final and binding upon the participants/winners
10. The winners shall be required to produce/submit photo identity/address proof as and when required by HTML. The winners may be required to sign the Terms and Conditions herein before accepting the prize. In case false/fake identification details are submitted, the concerned participant/winner shall be disqualified immediately from the contest.
11. Winners, if minor, must be accompanied by a parent/guardian for collecting their prize(s). Both the winner and the parent/guardian must sign this agreement and show their respective identification, which includes a photograph
12. HTML holds no responsibility or liability in case HTML is unable to inform the winner of his/her win due to non availability / wrong number or any other reason within a period of 30 days from holding of the event, despite having made the best of the efforts. In such a case HTML shall not be liable to proof the efforts made in this regard.
13. The winner is solely responsible for any other expenses related to the acceptance/use of the offer or participation in the contest.
14. Contestants shall indemnify HT Music against, all liability, cost, loss or expense arising out of acceptance of any prize(s) or participation in any contest including, but not limited to, personal injury and damage to property, whether direct or consequential, foreseeable, due to some negligent act or omission or otherwise, whatsoever.
15. The prizes shall be non negotiable and non transferable. In the event of any unforeseen circumstances, HTML reserves the sole right to offer an alternative prize of the same value.
16. This offer cannot be clubbed with any other offer.
17. In the event of any winner choosing not to accept the prize(s) or forfeit any and/or all claims qua the prize, HTML shall have the absolute discretion deal with such prize as it deems fit.
18. All entries will be treated as the property of HTML and can be used by HTML for any promotional and / or commercial activity & the participants/winners waive all rights of whatsoever nature in the said entries in favour of HTML by participating in the contest.
19. Participants/winners may be required by HTML to participate in a photo, video and/or film session and acknowledge that HTML has the absolute and exclusive right to use such publicity photos, videos and/or films in any medium and in any reasonable manner it may deem fit without any consideration or payment of similar nature to such participants/winners.
20. HTML in its absolute discretion may publicize, broadcast or otherwise disclose a participant's/winner's name, character, likeness, statements or any recording of their voice in advertising or promotional activities concerning this contest, or generally. HTML may promote or advertise that a winner has won the contest.
21. HTML reserves the right to extend or to cancel, or change the manner in which the contest is organized or discontinue or terminate the contest at any time or to accept or reject any or all entries at their absolute discretion without giving any prior notice without assigning any reason whatsoever.
22. Any attempt by a participant to deliberately damage or undermine the legitimate operation of the contest and/or web-site is a violation of Criminal and Civil Laws and should such an attempt be made, HTML reserves the right to seek damages from any such Candidate to the fullest extent permitted by law.
23. HTML reserves the right to disqualify any participant/winner if it has reasonable grounds to believe the participant/winner has breached any of these Terms and Conditions. In the event that any participant is disqualified from the contest, HTML in its sole discretion may decide whether a replacement participant should be selected. In this event, any further participant will be selected on the same criteria as the original participant and will be subject to these Terms and Conditions.
24. The Contest shall be governed by and construed in accordance with the laws of India. Any disputes, differences and, or, any other matters in relation to and arising out of the Contest and, or, pertaining to the rules and regulations and, or, the Terms and Conditions shall be referred to arbitration under the Arbitration & Conciliation Act, 1996. The arbitral tribunal shall consist of a sole arbitrator to be appointed by HTML. The venue of arbitration shall be New Delhi and the proceedings of such arbitration shall be in English Language only.
25. All disputes shall be subject to the exclusive jurisdiction of Delhi Courts only.
26. HTML in its absolute discretion reserves the right to add, alter, modify, change or vary all or any of these Terms & Conditions, wholly or in part, at anytime without giving any prior notice and the participant/winner agrees to abide by such additions, alterations, modifications and changes.
27. Participation in the contest implies acceptance of all the terms & conditions herein.

The contest activity starts from 5th October 2011 till 18th October 2011 exclusively for HTML'S radio division FEVER 104 FM listeners of Delhi, Mumbai, Bangalore and Kolkata. To play the contest, listeners shall click pictures of anything wrong that they see happening around and upload them on their respective cities Fever Facebook Page. 4 Pictures which get the maximum "likes" on the Facebook page will be announced as winners and each shall win a Nikon Coolpix camera. Employees of HTML, sponsors of the prizes, associated agencies and their immediate family members and relatives are not eligible to participate in this contest

1. HTML will not be responsible in any way for failure of any technology like server failure or IVRS applications etc and resultant inability of a listener for participation. HTML will not be responsible for alteration or unauthorized access to entries, or entries deleted by someone on the Facebook page, whether or not arising during operation or transmission as a result of server functions, virus, bugs or other causes beyond its control. Winner will be liable to pay the taxes (if any) as applicable on the winning Prize. The winner will be intimated by phone by HTML and shall collect the prizes from respective Fever 104 FM office's in each cities (address is available on www.fever.fm)
2. The winner shall be handed over the prize on production of valid documents for Photo ID proof and proof that the winning photograph was clicked by him / her only. Any failure on the part of the winner to comply with directions issued by HTML, shall entitle HTML, in its own discretion to cancel and forfeit the prize for the said winner and then the same prize will be given to the next lucky winner.
3. All the costs and expenses for collecting the Prize will be borne solely by the winner and HTML shall not entertain any claim, whatsoever. The winner is solely responsible for any other expenses related to the acceptance and use of the offer.
4. The winner shall bear any Gift tax / Logistics / extended warranty / accessories / any other government taxes if applicable, at the time of delivery as the same shall be levied. Winner accepts and understands that the registration and any and all other related costs and charges have to be borne by the winner failure of which shall eligible HTML to forfeit the prize. At no point winner shall make HTML liable or responsible for any additional charges to be paid by the winner for claiming the prizes.
5. The Prize shall not be transferable and no request shall be entertained by HTML for such transfer. All decisions by HTML regarding the selection of the winners shall be final and binding
6. Employees of HTML and its affiliates/subsidiaries, sponsors of the prizes, associated agencies, participating operators, their employees and their immediate family members and relatives are not eligible to participate in this contest.
7. HTML shall not be responsible for any loss or damage suffered by the participants while participating in the Contest.
8. Failure by HTML to enforce any of these Rules in any instance(s) shall not give rise to any claim by any person.
9. The contest shall be governed by and construed in accordance with the laws of India. 11. HTML in its absolute discretion reserves the right at anytime, without giving any previous notice to the participants, to add, alter, modify, change or vary all or any of these terms & conditions, wholly or in part, or to withdraw the contest.
12. The prize(s) for this Contest shall neither be assignable nor transferable under any circumstances.
13. In case of any dispute or difference in respect of the prize/ selection of winners, the decision of HTML shall be final and binding on all concerned.
14. Apart from the above-mentioned prize/s, nothing else will be provided to the winner. All applicable taxes, levies, cesses, insurances, transfers and other expenses, if any, will have to be borne and paid by the winner.
15. HTML shall on a best effort basis confirm the names/identity of the winners by calling the winners on their Mobile or Telephone Numbers. However, if the verification of the identity of the winners is not possible due to any reason(s) including but not limited to, the inability to contact the winner or any other reason beyond the reasonable control of HTML, the winners may verify the details published at the aforementioned website. All prizes shall be claimed by the winners, accompanied with documents specified herein below, from HTML within 15 days from the date of publishing of the Winners on the website. The documents required to be submitted along with the claim by the winner include the following (the document list is only indicative and not exhaustive and HTML shall be entitled to request the Subscriber to produce such other document/s from the winner as it may deem fit to its sole and absolute satisfaction:
• Identity Proof,
• Address Proof,
• PAN Card and
16. HTML at its sole discretion may also waive production of any of the aforesaid documents
17. Failure to claim the prize within the aforesaid 15 days period may result in disqualification and forfeiture of the prize and/or declaration of alternate winner which is at the sole discretion of HTML
18. If the winners fail to claim their prizes or submit the aforesaid documents to claim the prize within an extended grace period of three (3) months from the date of availability of the winner's details, then HTML reserves the right to forfeit such unclaimed prizes.
19. This offer in this Contest cannot be used in conjunction with any alternative offer or promotion.
20. Any upgrade with respect to the prize will be borne by the winner and additional amount, if any, would be paid directly by the winner and subject to availability and at the discretion of HTML
21. The prizes shall not be redeemable for cash, wherever applicable. No requests shall be entertained by HTML in this behalf.
22. The Winner shall be responsible to keep in safe custody the intimation letter and/or confirmations given/ issued to him by HTML In case of loss or damage or theft of the same, HTML reserves the right to issue duplicate(s) subject to such verifications and/or on such other term/s as it may desire.
23. HTML reserves the right to change/modify/amend the terms and conditions of the Prize at any time at its sole discretion.
24. HTML its vendor and/or its subsidiaries shall not be liable to any person or entity for any direct, indirect, incidental, special, punitive or consequential damages, including loss of profits, incurred by the winner or any third party, whether in connection with this contest, or for breach of any warranty or in tort.
25. HTML its vendors and its subsidiaries shall not be responsible for any claim/s arising out of any technical failure/s either before, during, or after the completion of the Contest including but not limited to any technical failures in the telephone lines, failure of servers or the failure to provide the correct contest score updates or any mistakes arising out of technical snags. Further, HTML shall not be responsible for any claims arising out of any failure(s) which are beyond the control of HTML or its vendors.
26. This Contest is subject to force majeure circumstances i.e. act of God or any circumstance beyond the control of HTML
27. The Contest is valid subject to the winner complying with all terms, conditions and/or formalities as required by HTML. Any failure on the part of the Subscriber to comply with the any specified term, condition and/or formality shall render the Subscriber liable for disqualification at the sole discretion of HTML
28. HTML reserves the right to extend, cancel, discontinue, prematurely withdraw, change, alter or modify this offer or any part thereof including the eligibility criteria at its sole discretion at anytime during its validity as may be required in view of business exigencies and/or changes by regulatory authority and/or statutory changes and the same shall be binding on the Subscriber.
29. HTML shall not be responsible for the quality, fitness, merchantability, defect or deficiency etc. of the Prize and no claim or request, whatsoever, in this respect shall be entertained by the HTML
30. HTML shall not be responsible for any IVR Error resulting in any Call discrepancy, technical errors, billing errors at Operator end.
31. participants/contestants shall indemnify HTML against, all liability, cost, loss or expense arising out of acceptance or use of any prize(s) or participation in any contest including, but not limited to, personal injury and/or damage, whether direct or consequential, foreseeable, due to some negligent act or omission or otherwise, whatsoever.
32. Participants/contestants understand and agree that the prizes to be won are third party products and are not manufactured or are a product of HTML. Thus any non - functionality, repair, damaged condition is not a responsibility of HTML and the winners/ participants/contestants shall directly approach the product's company authorized service center for any such complaint.
33. Photographs submitted can be used by HTML in any manner as it may deem fit and the winner shall not clim any sort of royalty etc. from HTML for the same. HTML in its absolute discretion may publicize, broadcast or otherwise disclose a participant's/winner's name, photograph, character, likeness, statements or any recording of their voice in advertising or promotional activities concerning this contest, and in any reasonable manner it may deem fit or generally without any consideration or payment of similar nature to such participants/winners. HTML may promote or advertise that a winner has won the contest.
34. Participation in the contest implies acceptance of all the terms & conditions associated with the contest.
